(In Kenya) High Court Bars Safaricom, Airtel, and Government from Future Internet Shutdowns

 


A landmark High Court ruling in Kenya has barred Safaricom, Airtel, the government, and the Communications Authority of Kenya (CA) from implementing future internet shutdowns without judicial oversight. The decision stems from a legal challenge by civil society groups, including the International Commission of Jurists (Kenya Section) and the Bloggers Association of Kenya (BAKE), who contested the legality of past internet disruptions.

The petitioners argue that such shutdowns infringe on fundamental rights, including freedom of expression and access to information. They are pushing for internet shutdowns to be declared unconstitutional unless authorized by a court. The ruling significantly impacts how Safaricom and other providers manage network access during government directives. The case is set for further hearing on June 23, 2025.
