US Immigration Judge Rules Palestinian Columbia Student Khalil Can Be Deported




A U.S. immigration judge has ruled that Palestinian activist Mahmoud Khalil can be deported, allowing the Trump administration to proceed with its efforts to remove the Columbia University student from the United States following his arrest in New York City in March. 


Judge Jamee Comans of the LaSalle Immigration Court in Louisiana made this ruling during a tense 90-minute hearing, although it does not represent a final decision on Khalil’s fate. Khalil, who has not been charged with any crime, has emerged as a prominent figure in the pro-Palestinian protest movement at Columbia. 


His deportation was deemed necessary based on a determination by Trump-appointed U.S. Secretary of State Marco Rubio, who argued that Khalil’s activism could undermine U.S. foreign policy interests.

During the hearing, Khalil attempted to address the court and expressed concerns about the lack of due process throughout the proceedings. Meanwhile, Khalil's lawyers raised objections to the evidence presented by the Trump administration, arguing they had insufficient time to prepare. 


Comans emphasized that her ruling was based on Rubio's letter, which accused Khalil of conducting "antisemitic protests" without alleging any legal violations. Following the hearing, Khalil’s supporters expressed their dismay, while Khalil himself maintained a positive demeanor, making a heart gesture to those supporting him. 


His legal team contends that the Trump administration is targeting him for exercising his right to free speech, asserting that criticism of U.S. policy regarding Israel should not be conflated with antisemitism. The decision comes at a time when the immigration court system faces scrutiny for potential biases, as judges are appointed through the U.S. Justice Department.
