Kanu's request for Nyako's recusal was quite bold, stating, "My lord, I have no confidence in this court anymore and I ask you to recuse yourself because you did not abide by the decision of the Supreme Court" . Nyako agreed, recognizing that proceeding with a trial where the defendant lacks confidence in the court would be unjust.

Nnamdi Kanu's lawyer, Alloy Ejimakor, requested a postponement of the trial, citing that his client was denied adequate time to prepare his defense. However, the proceedings took a dramatic turn when Kanu himself asked Justice Binta Nyako to recuse herself, stating he had lost confidence in her ability to handle the case impartially .

“Sit down! I say you should sit down,” adding “my lord, I have no confidence in this court any more and I ask you to recuse yourself because you did not abide by the decision of the Supreme Court".

Kanu accused Nyako of disregarding Supreme Court orders, which led to her surprise decision to step down from the trial. She agreed that continuing the trial without the defendant's trust would be unjust and forwarded the case file to the Chief Judge for reassignment .

Despite prosecution lawyer Adegboyega Awomolo's request to proceed with the trial, Nyako agreed to withdraw, expressing her willingness to maintain the integrity of the judicial process .

This development adds another layer of complexity to Kanu's ongoing treason and terrorism trial, which has been ongoing since 2015. The case will now be reassigned to another judge, further delaying a resolution in the federal government's case against the IPOB leader . The IPOB leader maintains his innocence, denying all seven charges against him .
