Heartbroken Man Asks Wife To Return His Donated Kidney Or Pay $1.5m Compensation After She Filed For Divorce

 A man identified as Dr Richard Batista has demanded that his wife, Dawnell, either return the kidney he donated for her or pay him $1.5 million after she filed for divorce.



Richard Batista and Dawnell got married in 1990 with the union producing three children.


Dr Batista has now revealed that due to Dawnell medical issues, their marriage had already been on the rocks.

He said after having two failed kidney transplants, he decided that he would donate one of his kidneys to save both her life and their marriage in 2001.


 "My first priority was to save her life. The second bonus was to turn the marriage around", he told newsmen then.


Even Batista saved Dawnell's life, she filed for divorce in 2005.


He also accused her of having an affair, responding by including a demand for his donated kidney or compensation of $1.5 million as part of the settlement in an extraordinary request.


Batista through his lawyer, Dominic Barbara, is 'asking for the value of the kidney' that he gave Dawnell.





His move in getting either the kidney or the compensation during the divorce proceedings was however unsuccessful.




The Nassau County Supreme Court in a 10-page ruling, rejected Batista request and ruled that the kidney was a gift.



Matrimonial referee Jeffrey Grob said:


"The defendant’s effort to pursue and extract monetary compensation therefore not only runs afoul of the statutory prescription, but conceivably may expose the defendant to criminal prosecution".




Dawnell's attorney, Douglas Rothkopf, while reacting to the outcome said: “We are pleased with the decision.


"Human organs are not commodities that can be bought or sold".
