The Supreme Court on Friday 15th December 2023, nullified the 26th October judgement of An Appeal Court sitting in Enugu ordering the release of Indigenous People of Biafra (IPOB) leader, Mazi Nnamdi Kanu. Although the apex court, in a unanimous decision by a five-member panel of Justices, acknowledged that the Federal Government acted “irresponsibly” when it forcefully brought Mazi Nnamdi Kanu back to the country from Kenya, against all known laws, the court however held that it was not enough to divest the trial court of its jurisdiction to continue with the case. In the judgement prepared by Justice Garba Mohammed but read by Justice Emmanuel Agim, the Supreme Court held that the recourse open to Mazi Nnamdi Kanu was for him to institute a civil action against the federal government.

The IPOB leader, who was first arrested by security agents in Lagos on October 14, 2015, has been in detention since June 29, 2021. In 2017, The South-East Governors' Forum, led by former Governor of Ebonyi state, David Umahi, banned IPOB activities in their respective states. The development led to the Federal Government listing IPOB as a terrorist organisation three days afterwards.
