Breaking: PEPC Strikes Out APM's Suit Against Tinubu, Shettima

 

The petition filed by the Allied Peoples Movement (APM) has been dismissed by the Presidential Election Petition Court (PEPC).

In a decision, the PEPC sustained the preliminary objections made by the Independent National Electoral Commission (INEC), the All Progressives Congress (APC), President Bola Tinubu, Kashim Shettima, and Kabir Masari against the petition's suitability.

The subject of nomination, which is a pre-election topic, is outside the court's authority, sitting as an election tribunal, according to Justice Haruna Tsammani, who read the lead decision.

He said that the matter should have been brought before the Federal High Court and added that even if the PEPC were to hear it, it would be time-barred.

Additionally, Justice Tsammani ruled that the petitioner lacked locus standi to file the lawsuit because it was against the law for one political party to contest another's candidate nomination procedure.

As stated in sections 131 and 137 of the Constitution, the PEPC Chairman concluded that an invalid nomination or a multiple nomination did not constitute as a reason for disqualification with regard to the presidential election.

In addition, he claimed that Masari, who the APC had chosen as a stand-in (for the role of vice president), was not a necessary party to the petition because he neither ran for office nor was elected.

Because the petitioner made no claim against Masari, Justice Tsammani likewise determined that he was not a necessary party.

He is now evaluating the merits of the petition.
