On Friday 16 September 2022, The National Industrial Court of Abuja dismissed the federal government's request asking the honourable court to direct the striking Academic Staff Union of Universities lecturers back to the classroom pending the determination of a government suit challenging the strike action.
The striking union had been dragged to court by Labour and Employment minister Chris Ngige, following the deadline given to him by president Muhammadu Buhari to find a resolution to the lingering strike action by ASUU. The suit which was initially heard by Justice Hamman Polycarp on Monday, September 12, 2022 was adjourned to September 16, 2022.

Counsel for the defendant (ASUU) Femi Falana (SAN) stated that the union was meeting with stakeholders to ensure that the lingering crisis was resolved. He appealed to the Federal Government to cooperate with the union to resolve the issue.
